# New Law Would Force Elon Musk to Be Drug Tested for His Government Work

Congressional Democrats want unelected government hatchet man and [ketamine enthusiast Elon Musk](<https://futurism.com/elon-musk-ketamine-don-lemon>) to be regularly and randomly drug-tested.

In a [statement announcing the bill](<https://sherrill.house.gov/media/press-releases/sherrill-introduces-bill-to-require-elon-musk-to-pass-drug-test-to-maintain-special-government-employee-status>), New Jersey Democrat Mikie Sherrill said that the longshot legislation would require Musk and his staffers at the Department of Government Efficiency (DOGE) to pass a drug test to retain their status as special government employees.

Along with Musk's attested and [problematic drug use](<https://futurism.com/neoscope/elon-musk-drug-use-government-security-clearance>) — which has already led to him being [mandatorily drug tested](<https://futurism.com/elon-musk-drug-test-custody>) by the government in the past — one of the [multi-hyphenate's top staffers](<https://futurism.com/neoscope/elon-musk-doge-staffer-ketamine>), Alexandra Beynon, used to be head of engineering at Mindbloom, a telehealth service her husband cofounded that prescribes people therapeutic ketamine.

Generally speaking, special government employee status has typically been granted to guest experts and consultants [brought on to advise](<https://www.govexec.com/oversight/2015/09/clinton-email-fracas-raises-question-what-special-government-employee/120362/>) permanent executive branch officials. Under the [rules that govern them](<https://www.doi.gov/ethics/special-government-employees>), special government employees are not allowed access to the White House for more than 130 days per calendar year — and eventually, Musk and his cronies will run out of time on their temporary passes.

The congresswoman added that her bill was inspired, in part, by "[Signalgate](<https://thehill.com/opinion/5224731-signalgate-trump-breach-security/>)": the [scandal that erupted](<https://futurism.com/signal-group-chat-passwords-leaked>) in the wake of a journalist being accidentally added by a national security advisor to an unsecured Signal group text that [discussed Yemen bombing plans](<https://futurism.com/trump-national-security-bombing-chat>).

"Those with access to sensitive information must be thoroughly vetted, clear-eyed, and exercise good judgment," Sherill declared.

Notably, this bill was announced right before [*Politico*'s bombshell reporting](<https://www.politico.com/news/magazine/2025/04/02/trump-musk-leaving-political-liability-00265784>) that Trump has been telling his inner circle that Musk is on his way out of government.

Musk and the [White House](<https://x.com/PressSec/status/1907476290438901863>) have both claimed *Politico*'s reporting, which was later [corroborated by *NBC*](<https://www.cnbc.com/2025/04/02/elon-musk-trump-doge-tesla-white-house-wisconsin-supreme-court.html>), is [misleading](<https://x.com/elonmusk/status/1907519073287635313>). Still, this is far from the first time the billionaire's substance use has become an issue — first with the [Securities and Exchange Commission](<https://www.bloomberg.com/news/articles/2018-09-27/musk-picked-weed-linked-price-to-impress-girlfriend-sec-says?sref=YfHlo0rL>), then again [with NASA](<https://futurism.com/the-byte/nasa-drugs-spacex>), and now with DOGE.

Ironically enough, it's unclear whether ketamine, the powerful sedative that appears to be [Musk's drug of choice](<https://futurism.com/neoscope/elon-musk-drug-explanation>), is even [on federal substance screening panels](<https://www.govexec.com/workforce/2024/01/could-ketamine-use-cause-problems-your-security-clearance-eligibility/393065/>). Unless he's [snorting the *other* white powder](<https://www.samhsa.gov/substance-use/drug-free-workplace/drug-testing-resources>) on taxpayer time, it's possible that the bill — which is [unlikely to pass](<https://www.huffpost.com/entry/drug-testing-bill-elon-musk-doge_n_67ed84ede4b00a8085e3a220?yptr=yahoo>) because the GOP controls both houses of Congress — wouldn't even have the intended results.
